Acceptance of terms

These Terms & Conditions ("Terms") govern your use of dmetallic.com (the "Website") and the products and services offered by Delta Metallic Trading L.L.C. ("Delta Metallic", "we", "us", or "our"). By accessing the Website, browsing our catalogue, placing an order, or using any other feature of the Website, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, please do not use the Website. We may update these Terms from time to time. Continued use of the Website after a change indicates your acceptance of the revised Terms.

Definitions

In these Terms, unless the context requires otherwise:

• "We", "us", "our" means Delta Metallic Trading L.L.C.
• "You", "your", "Customer" means any person who accesses the Website, places an order, or otherwise interacts with us.
• "Products" means the architectural hardware items offered for sale on the Website or through our showroom.
• "Order" means your offer to purchase Products from us, submitted via the Website, WhatsApp, email, or in person.
• "Trade Buyer" means a contractor, architect, interior designer, developer, hotelier, or reseller purchasing Products in the course of their trade or profession.
• "Working Day" means Sunday through Thursday, excluding U.A.E. public holidays.

Use of the website

You may use the Website for legitimate purposes only — browsing our catalogue, placing orders, requesting quotations, contacting us, and reading editorial content. By using the Website, you agree NOT to:

• Use the Website in any way that breaches U.A.E. or applicable international law.
• Use any automated tool, scraper, bot, or crawler to harvest data from the Website without our prior written permission.
• Reverse engineer, decompile, or attempt to extract the source code of the Website.
• Introduce viruses, malware, or any other harmful code to the Website.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use the Website for any commercial purpose other than purchasing our Products, including reselling content or images without permission.

We reserve the right to refuse service, restrict access, or terminate accounts that breach these Terms.

Account registration

You may browse and purchase from the Website as a guest, or you may create an account for a faster checkout experience and to track your order history.

When you create an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and not share your account credentials.
• Notify us immediately of any unauthorised access to your account.
• Accept responsibility for all activity that occurs under your account.

Trade accounts require additional verification, including company details, trade licence information, and VAT registration where applicable. We reserve the right to verify trade buyer status and to suspend or close accounts where the information provided is found to be inaccurate.

Product information

We take care to ensure that product descriptions, dimensions, finishes, and images on the Website accurately represent the Products. However:

• Finishes: hand-finished products (particularly antique brass and patinated finishes) naturally vary from batch to batch. Photographs and samples are indicative; minor variation between the image and the delivered Product is part of the craft and not a defect.
• Dimensions: dimensions are stated in millimetres and are subject to standard manufacturing tolerances. Variations within manufacturer tolerance are not grounds for return.
• Colour reproduction: colours displayed on your screen may vary slightly from the actual Product due to screen calibration and lighting conditions.
• Stock availability: all Products are subject to availability. Where a Product becomes unavailable after you have placed an order, we will contact you with options including substitution, partial fulfilment, or a full refund.

For trade projects, we strongly recommend requesting physical samples or visiting our Dubai showroom before placing large orders.

Pricing and payment

All prices displayed on the Website are in U.A.E. Dirhams (AED) and are inclusive of U.A.E. Value Added Tax (VAT) where applicable, unless stated otherwise. Prices for international orders may be displayed in other currencies for convenience; payment is processed in AED at the prevailing exchange rate.

We accept payment via the methods displayed at checkout. By submitting payment information, you confirm that you are authorised to use the payment method provided.

Trade pricing: approved trade accounts may be eligible for trade pricing on confirmed quotations. Trade pricing is not available on the public website and is communicated separately for each project quotation.

We reserve the right to correct pricing errors on the Website. Where a Product is listed at an incorrect price, we will contact you before processing the order and you may choose to confirm the order at the correct price or cancel for a full refund.

Orders and acceptance

When you place an order through the Website, you are making an offer to purchase the Products. Your order is not accepted until we send you an order confirmation by email.

We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) where:

• A Product is out of stock or no longer available.
• A pricing or product description error has occurred.
• We are unable to verify the payment or shipping information provided.
• We suspect fraudulent activity.
• The order does not comply with these Terms or applicable law.

Where an order is cancelled, any payment received will be refunded in full to the original payment method within 7 to 14 working days.

Delivery

Delta Metallic delivers Products to addresses worldwide, subject to shipping availability and any restrictions imposed by destination customs authorities. Delivery options, timelines, and charges are displayed at checkout based on the destination address.

Delivery timelines

• Within Dubai: standard in-stock items typically delivered within 1 to 3 working days.
• Wider U.A.E.: typically 2 to 5 working days.
• GCC and international: timelines vary by destination and customs clearance, typically 5 to 21 working days.
• Special-order and project items: lead times confirmed at the point of quotation.

Delivery timelines are estimates and not guarantees. We are not liable for delays caused by shipping partners, customs authorities, or other circumstances beyond our reasonable control.

Risk and title

Risk in the Products passes to you upon delivery to the address you specified. Title (ownership) passes to you only when we have received full payment in cleared funds. Until then, the Products remain our property.

International orders

International customers are responsible for any import duties, customs fees, or taxes imposed by their destination country. These charges are not included in the order total and are payable by you on arrival.

Returns and warranty

Returns policy

Sales are final on used and undamaged Products. Due to the nature of architectural hardware — which is typically installed or specified to project requirements — we do not accept returns on Products that have been used, installed, fitted, or removed from original packaging.

This returns policy does NOT limit your statutory consumer rights under U.A.E. Federal Law No. 15 of 2020 on Consumer Protection, which are preserved in full.

Damaged or defective Products

If a Product arrives damaged, defective, or not matching its description, contact us within 7 working days of delivery with photographs and a description of the issue. We will arrange replacement, repair, or refund as appropriate, in compliance with applicable consumer protection law.

Manufacturer warranty

All Products are covered by the original manufacturer's warranty. Warranty terms, duration, and coverage vary by brand and Product category. Full warranty details are confirmed at the point of quotation or order. We support warranty claims locally so you are not required to deal directly with overseas manufacturers.

Wrong item received

If you receive a Product that does not match what was ordered, contact us within 7 working days of delivery and we will arrange the correct item to be shipped at no additional cost.

Intellectual property

All content on the Website — including but not limited to text, images, logos, graphics, product photography, page layouts, code, and design — is the property of Delta Metallic Trading L.L.C. or its licensors and is protected by U.A.E. and international intellectual property law.

You may not:

• Copy, reproduce, distribute, or republish any part of the Website without our prior written permission.
• Use our logos, brand names, or trademarks without written authorisation.
• Use product photography for commercial purposes (including reselling, marketing, or social media monetisation) without our permission.

Product brand names and trademarks displayed on the Website are the property of their respective owners. We display them solely to identify the products we distribute.

Liability and governing law

Limitation of liability

To the maximum extent permitted by applicable law, Delta Metallic's total liability arising out of or in connection with any order or use of the Website shall not exceed the total amount paid by you for the specific Order giving rise to the claim.

We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of business opportunity, or loss of data.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, government action, pandemics, war, terrorism, strikes, supplier failures, or disruption to shipping or telecommunications networks.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates and the applicable laws of the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Dubai, U.A.E.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
